1. Introduction

 

Welcome to York Cove Hotel gym, a trading name of de Villiers Company Pty Ltd (ABN 43 661 886 264).

By signing up for a membership with us, you agree to the following terms and conditions. Please read them carefully.

 

2. Membership

 

(a) Membership entitles you to access York Cove Hotel facilities and participate in available fitness programs.

(b) All members must be at least 18 years of age. Individuals between 16 and 18 years of age may join with parental consent.

(c) Membership fees are $20 per week, payable each week. A one-time sign-up fee of $10 applies to all new memberships.

3. Payment Terms

​

(a) Fees are due regardless of whether or not you use the gym's facilities.

(b) Payment will be taken via direct debit from your nominated bank account or credit card.

(c) It is your responsibility to ensure sufficient funds are available to cover the weekly membership fee.

(d) A dishonour fee of $10 will be charged for any failed payment.

 

4. Cancellation of Membership

(a) Members may cancel their membership by providing at least 2 weeks' written notice or via the online members portal.

(b) During the notice period, normal gym fees will be deducted.

(c) For cancellation, the sign-up fee is non-refundable.

(d) Membership must be in good standing with no outstanding payments due at the time of request for cancellation or pausing.

 

5. Access and Use of Facilities

(a) Access to the gym is 24/7 daily.

(b) Members are provided with an access key for entry during hours, subject to the gym's discretion and applicable policies.

(c) Members agree to sanitize and wipe down machines and equipment after use to maintain a clean and hygienic environment.

(d) Members agree that they have sufficient knowledge in using gym equipment and accept all responsibility for using the equipment safely and as intended.

(e) Appropriate footwear must be worn at all times in the gym area to ensure safety and hygiene.

 

6. Health, Safety, and Conduct

(a) Members must complete a health questionnaire and disclose any health conditions or concerns before starting at the gym.

(b) Members agree to follow the gym rules, maintain respectful conduct, and respect the health and safety of others at all times.

(c) The gym is under 24-hour surveillance, and members agree to be recorded for security purposes and in the event of any issues or disagreements.

 

7. Liability and Indemnity

(a) York Cove Hotel is not liable for any personal property that is damaged, lost, or stolen while on the premises.

(b) Members are responsible for any damage they cause to gym facilities or equipment.

(c) Members agree to indemnify York Cove Hotel against any claims, liabilities, damages, and costs that may arise from their actions within the gym & pool premises.

 

8. Changes to Terms and Conditions

(a) York Cove Hotel reserves the right to change these terms and conditions at any time.

(b) Members will be notified of any significant changes in writing or email via the member portal.
